Terms of Use
These Terms of Use govern access to and use of SPINESPINESPINE, available at spinespinespine.tools. By using the website or its editor, you agree to these Terms. If you do not agree, do not use the service.
1. The service
SPINESPINESPINE is a browser-based tool for creating and exporting animated mockups of books and posters.
The current service is provided free of charge. It does not offer user accounts, cloud project storage, subscriptions or payment processing.
The operator may modify, suspend or discontinue all or part of the service at any time, including for maintenance, security, technical or development reasons.
2. Local processing and storage
Uploaded artwork and backgrounds are processed locally by your browser. SPINESPINESPINE does not receive or store those files on its servers.
Projects may be stored in the browser on your device. Local browser data may be lost when you clear site data, use private browsing, change browser or device, reach browser storage limits, or experience a software or hardware failure.
You are responsible for keeping independent copies of your source files, project information and exports. SPINESPINESPINE is not a backup or archival service.
3. Your content
You retain all rights you hold in artwork, images, video and other material that you use with SPINESPINESPINE.
Because uploaded files remain on your device, you do not grant SPINESPINESPINE a licence to host, publish, reproduce or distribute them.
You are solely responsible for ensuring that you have all rights, licences, permissions and lawful grounds needed to use the content and to create, publish, distribute or commercially exploit any resulting export.
You must not use SPINESPINESPINE with content that:
- infringes copyright, trademark, privacy, publicity or other rights;
- is unlawful, fraudulent, defamatory or deliberately harmful;
- contains malware or is intended to disrupt, damage or gain unauthorised access to systems or data;
- is used in a manner that violates applicable law.
The licence to use the animations and mockups you generate with SPINESPINESPINE, including the restriction on commercial use, is set out in Section 4.
4. Licence and permitted use
Alberto Guglielmi retains all rights in SPINESPINESPINE, including its software, source code, interface, visual identity, three-dimensional models, motion presets, animation systems, templates, graphics, documentation and other original components.
Subject to these Terms, you are granted a limited, non-exclusive and non-transferable licence to use outputs generated with SPINESPINESPINE for:
- personal and experimental projects;
- educational and academic work;
- non-commercial artistic and editorial projects;
- presentations and exhibitions that do not promote or sell goods or services;
- a personal or professional portfolio showcasing your own work.
This licence does not transfer ownership of SPINESPINESPINE or any of its original components.
5. Commercial use
Commercial use of outputs generated with SPINESPINESPINE is not permitted without prior written authorisation from Alberto Guglielmi.
Commercial use includes any use that directly or indirectly promotes, advertises, markets, sells or supports the sale of goods or services, including:
- product images, product pages or listings in online or physical shops;
- advertising campaigns, paid media and sponsored content;
- promotional content published by a brand, company, retailer or commercial organisation;
- social media content intended to market a product, service or business;
- client work or deliverables produced for payment;
- use on commercial websites, applications, marketplaces or e-commerce platforms;
- packaging, catalogues, presentations or promotional materials for a business;
- resale, sublicensing, redistribution or commercial exploitation of an output;
- offering outputs generated with SPINESPINESPINE as part of a paid service.
A business may use SPINESPINESPINE privately for internal testing and evaluation, but it may not publish, distribute or commercially exploit an output without obtaining a commercial licence.
To request permission or a commercial licence, contact contact@spinespinespine.tools.
Permission is valid only when granted expressly in writing. Silence, access to the tool or the ability to export an output does not constitute permission for commercial use.
6. Prohibited uses
You may not:
- interfere with or overload the website or its infrastructure;
- attempt to bypass security or usage restrictions;
- use automated systems to generate traffic or requests that unreasonably burden the service;
- remove, conceal or misrepresent notices concerning SPINESPINESPINE or its ownership;
- claim ownership of SPINESPINESPINE, its software, models, presets or original components;
- sell, sublicense, redistribute or make the tool itself available to third parties;
- reproduce or extract SPINESPINESPINE’s models, motion presets, interface or source code for use in another product or service;
- use the SPINESPINESPINE name, logo or visual identity in a way that creates confusion about the source of another product or service, or falsely suggest that Alberto Guglielmi or SPINESPINESPINE endorses, sponsors or is affiliated with a product, company or campaign;
- use the service or its outputs in violation of applicable law or third-party rights.
7. Termination of the licence
The licence granted under these Terms automatically terminates if you breach these Terms.
Following termination, you must stop any unauthorised use of SPINESPINESPINE outputs and remove them from websites, shops, advertisements, social media accounts and other public or commercial materials, where reasonably possible.
Termination does not affect any rights or remedies relating to an earlier breach.
8. Intellectual property in the service
Third-party libraries, typefaces, icons and other components remain subject to their respective licences and terms.
These Terms do not transfer ownership of SPINESPINESPINE or grant permission to use its name, logo or branding except as necessary to refer accurately to the service.
9. Analytics and third-party infrastructure
The service relies on third-party infrastructure and analytics providers, including Vercel and Umami. Their systems may be unavailable, changed or discontinued independently of SPINESPINESPINE.
Information about the limited technical data processed through those services is provided in the Privacy Notice.
10. Availability and compatibility
SPINESPINESPINE is provided on an evolving basis. Features, rendering results, supported formats, export quality and performance may vary between browsers, devices, graphics hardware, operating systems and available memory.
The operator does not guarantee that:
- every feature will work on every device or browser;
- exports will be error-free or suitable for a particular production workflow;
- the service will always be available, uninterrupted or free from defects;
- future versions will remain compatible with previously stored browser data or project files.
11. No warranty
SPINESPINESPINE is provided “as is” and “as available.”
To the maximum extent permitted by applicable law, the operator gives no express or implied warranty concerning availability, accuracy, compatibility, merchantability, fitness for a particular purpose, non-infringement or preservation of locally stored data.
Nothing in these Terms limits any warranty or statutory right that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by applicable law, Alberto Guglielmi is not liable for indirect, incidental, special or consequential loss arising from the use of or inability to use SPINESPINESPINE, including loss of profits, opportunity, reputation, data, artwork, projects or exports.
Where liability cannot be excluded, it is limited to the extent permitted by law and to loss that was reasonably foreseeable as a direct result of the relevant breach.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability arising from fraud, fraudulent misrepresentation, wilful misconduct, or death or personal injury caused by negligence where applicable.
13. Reporting problems or infringement
To report a security issue, technical problem or suspected infringement involving the SPINESPINESPINE website or branding, contact contact@spinespinespine.tools.
SPINESPINESPINE cannot remove or inspect artwork that remains exclusively on another user’s device.
14. Changes to the service or these Terms
The operator may update these Terms to reflect changes to the service, law, security requirements or third-party providers.
The revised Terms become effective when published with a new “Last updated” date. Continued use after that date means that you accept the revised Terms, to the extent permitted by applicable law.
15. Governing law and disputes
These Terms are governed by Italian law, without prejudice to mandatory protections available under the law of the country in which a consumer habitually resides.
Any dispute is subject to the courts determined by applicable law. If you are a consumer, this clause does not remove any mandatory right to bring proceedings before the courts of your place of residence.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect. The invalid provision will be interpreted or replaced only to the minimum extent necessary to make it lawful and enforceable.
